What Percentage is Assigned by the VA to a Particular Disability?

Ever wonder what percentage the Department of Veterans Affairs (“VA”) assigns to a particular disability?  You can find out on the VA’s website.  VA has a web page that explains its ratings schedule condition by condition.  It is called the Veterans Benefits Administration References – Web Automated Reference Material System (WARMS).  It is the online version of the federal regulations found in Title 38 of the Code of Federal Regulations (“C.F.R.”) Book C, Schedule for Rating Disabilities.  The Schedule spells out the criteria and rules that VA uses to assign certain percentages for a condition.

How Much Does VA Pay For a Disability Rating?

This depends on what percentage you are rated.  VA rates claims from 10% to 100%, in 10% increments.  A veteran’s service connected compensation is based upon their rating and whether they have a spouse of other dependents.  Here are the compensation rates shown on the VA website effective December 1, 2012:

FOOTNOTES:

  1. Rates for each school child are shown separately. They are not included with any other compensation rates. All other entries on this chart reflecting a rate for children show the rate payable for children under 18 or helpless. To find the amount payable to a 70% disabled Veteran with a spouse and four children, one of whom is over 18 and attending school, take the 70% rate for a veteran with a spouse and 3 children, $1,591, and add the rate for one school child, $176. The total amount payable is $1,767.
  2. Where the veteran has a spouse who is determined to require A/A, add the figure shown as “additional for A/A spouse” to the amount shown for the proper dependency code. For example, veteran has A/A spouse and 2 minor children and is 70% disabled. Add $101, additional for A/A spouse, to the rate for a 70% veteran with dependency code 12, $1,537. The total amount payable is $1,638.
